When two drivers collided on a back road after one attempted to pass the other, it seemed like a straightforward accident case—especially with a police officer on scene and dash cam footage to review. But one driver wasn't satisfied with how things played out and transformed a simple traffic incident into something far more complicated. Who’s At Fault Content creator Kaniye (@iamkaniye) recently shared how a roadside collision evolved into something far more serious. In a TikTok, Kaniye explains he was driving on a back road when he attempted to pass a slow-moving vehicle ahead of him. According to Kaniye, the other driver accelerated and crossed into the oncoming lane, forcing him off the road and into the grass. "Luckily, I got a decently fast car, so I was able to speed up, pass him, and get back on the road," Kaniye says. However, as he re-entered the roadway, the other driver struck his passenger door. A police officer who witnessed the incident from nearby pulled both drivers over. The other driver immediately claimed that Kaniye had hit him and said he had dash cam footage to prove it. "I was happy to hear that," Kaniye says. While one officer reviewed the footage with the other driver, Kaniye spoke with a second officer who told him that if his account matched the dash cam video, the case would go in his favor. After reviewing the footage, the male officer determined that both drivers shared some responsibility. Kaniye says he received a citation for passing in a no-passing zone, while the other driver received what Kaniye described as "a way longer citation." The situation escalated when the other driver demanded payment. "The other guy wanted to ban a payment from me, saying that I need to pay him $6,000 to fix his car and depreciation," Kaniye explains. The driver also claimed Kaniye had no insurance and committed a hit-and-run—both of which Kaniye says were false. When the driver threatened to sue, Kaniye told him to proceed, confident that the lies would be exposed in court. The insurance company's decision came down firmly in Kaniye's favor. "The insurance immediately said that he was 100% liable and I was 0% liable," Kaniye says. Car Accident Claim Escalates Despite this ruling, the other driver refused to accept accountability and filed a complaint against Kaniye with the police department, drawing in the police chief and other officials. According to Kaniye, authorities determined the other driver had been lying and refusing to take responsibility for the accident. "Now it's further on into reaching a criminal case now," Kaniye says, adding that he would keep followers updated on the situation. In at-fault states, the driver determined to be responsible for the accident is typically liable for damages. Insurance companies can assign percentages of fault to each party, which directly affects how claims are paid out, according to the Insurance Information Institute. Staged accident fraud schemes cost the insurance industry billions of dollars annually and result in higher premiums for all drivers. Criminals often make false statements as part of these schemes, including claiming injuries that didn't occur or misrepresenting how an accident happened. When investigating suspicious claims, insurance companies look for inconsistencies in statements and evidence that contradict the reported version of events, according to the National Insurance Crime Bureau. When someone files false claims or makes demonstrably false statements to insurance companies (like claiming someone was uninsured when they had coverage, or alleging a hit-and-run when police were present) they risk serious consequences, including criminal charges that can result in felony prosecution.
