The contract stipulates the delivery of 8,000 tonnes of graphite annually over a four-year period.However, Tesla issued its first notice of default in July 2025, claiming that Syrah had failed to deliver compliant samples of active anode material from Vidalia. The original deadlines were subsequently extended multiple times. This was also the case in January of this year, when the deadline for resolving the default was extended to 16 March 2026, subject to approval by the US Department of Energy.Syrah has now announced that Tesla considers the alleged default to have been resolved. According to the company, Tesla has accepted that Syrah is producing compliant active anode material samples and has made sufficient progress in remedying the alleged breach of contract. Tesla has therefore withdrawn its intention to terminate the offtake agreement.However, the matter has not yet been fully resolved. According to Syrah, Tesla still retains the right to terminate the agreement if the final qualification of the anode material produced in Vidalia is not achieved. Syrah stated that the qualification tests with Tesla are already at an advanced stage of the approval process.The Vidalia facility has an annual production capacity of 11,250 tonnes of active anode material. With the Louisiana plant, Syrah aims to establish itself as the first major non-Chinese supplier of battery-grade graphite in the United States.According to statements made in 2021, Tesla was set to become the primary customer for a planned expansion of the Vidalia site and had secured the majority of the future production capacity at a fixed price.The interim solution now agreed may provide short-term relief for the Australian commodity company, but concerns evidently remain.
