Tindakan sebuah Toyota Vellfire yang menggunakan lampu mata arah memakan diri apabila kereta itu ditahan di Batu Caves.


Jabatan Siasatan Dan Penguatkuasaan Trafik PDRM (JSPT) mendapati kenderaan tersebut menggunakan lampu mata arah berwarna biru. Pemasangan lampu itu pada kenderaan persendirian adalah suatu kesalahan dan boleh diambil tindakan.

Penggunaan Lampu Mata Arah Pada Kenderaan Persendirian

Memandangkan isu ini sering timbul di media sosial, JSPT berkata mereka sentiasa memantau penggunaan lampu tersebut pada kenderaan persendirian yang suka mengambil kesempatan dan berlagak seperti pegawai penguatkuasa.

Pada 12/09/2022, anggota JSPT telah menahan sebuah MPV jenis Toyota Vellfire yang dipandu oleh seorang lelaki berhampiran Kawasan Industri Batu Caves. Kenderaan tersebut didapati telah menggunakan lampu mata arah biru di bahagian cermin hadapan di atas dashboard.

Pemandu tersebut telah disiasat di bawah Kaedah 94 Kaedah-Kaedah Kenderaan Motor (Pembuatan dan Penggunaan) 1959 dimana jika disabitkan kesalahan, boleh dikenakan hukuman denda tidak lebih daripada RM2,000 atau penjara tidak melebihi (6) bulan.

Siapa Yang Boleh Guna?

JSPT menegaskan mana-mana pemilik kenderaan yang mengubah suai dan menggunakan lampu mata arah pada kenderaan persendirian adalah menjadi suatu kesalahan dan boleh diambil tindakan.

Menurut Kaedah-kaedah Lalu Lintas Jalan 1959, hanya kenderaan dalam tugas kecemasan seperti kenderaan Polis, Bomba, Ambulans dan JPJ sahaja dibenarkan mendapat hak laluan mengatasi kenderaan lain dengan cara membunyikan siren tertentu, loceng atau hon dua nada.

Tetapi, sesebuah kenderaan rasmi yang telah diberi kebenaran untuk memasang dan menggunakan lampu ini hanya boleh menggunakannya semasa menjalankan tugas-tugas rasmi sahaja. Alat ini tidak boleh digunakan dengan sewenangnya kerana ini akan mengganggu aliran lalu lintas.

Sementara itu menurut Kaedah 138(1) Kaedah-Kaedah Kenderaan Motor (pembinaan dan penggunaan) 1959, Ketua Pengarah JPJ Malaysia mempunyai kuasa untuk mengecualikan mana-mana kenderaan daripada mematuhi mana-mana kaedah yang sedia ada.

Kenderaan kegunaan persendirian tidak boleh dan tidak akan dibenarkan memasang alat tersebut. Segala pengubahsuaian kenderaan tanpa kebenaran Jabatan Pengakutan Jalan (JPJ) boleh dikenakan tindakan di bawah Peraturan 138, Kaedah-kaedah Lalu Lintas Jalan 170/59. Jika disabitkan kesalahan, boleh dikenakan hukuman penjara tidak lebih enam tahun atau denda tidak lebih RM2,000.
