If that area is shared with a neighbor, there are a few regulations that drivers have to obey. If the driveway is a shared one itself, then both properties can use it without incurring a fine or penalty.But there are rules that drivers have to follow. According to the Highways Act 1980, which is applicable in England and Wales, individuals must not obstruct a highway, including a shared driveway. Essentially, it means that no resident has the authority to block the driveway with their car. If they are seen to be doing so, there is a possibility that they could incur a fine for doing so. In reality, however, there are very few instances where this is reported.The Highways Act also says it is an offence to keep items on a 'communal driveway.' These items include waste or recycling bins, and if law enforcement sees them, it could deem them to be 'obstructing a highway,' and thus, they could issue a fine. It does sound slightly confusing, and in some ways, it is.
