The sign claims the truck and its company are not responsible for broken windshields.Does slapping a sign on the back of a truck and declaring no responsibility really work? The answer is, it depends."I was actually a victim of this circumstance one time with a truck that had on the back, not responsible for windshield damage. There's a difference between whether an object falls off a truck or a vehicle, or whether a truck or vehicle picks the object up off the road," said David Daggett, Daggett Shuler, Attorneys at Law. Daggett explains it this way: AdvertisementAdvertisementIf a vehicle picks up a rock or something off the road and it flies into your windshield, there's no liability or responsibility. If something the truck is carrying falls off (whether that be a rock, stick, tool, or a couch), then they're responsible. It's called failure to secure a load. But you have to be able to prove that. "It could be your word against the truck driver's word or the other vehicle's word. Just like anything else, you want to document it. The best way to document it is with an uninterested witness who may have seen the same thing, or photographs," said Daggett. This is where a dash cam comes into play, or a phone mounted and recording whenever you drive, or a picture of what was in the roadway. But we don't always have the evidence. So while there is damage, it may be hard to prove responsibility... and get paid for those damages.
